Mespack S.L., wins appeal against Bossar, S.L.

Mespack S.L., wins appeal against Bossar, S.L., at the supreme court for Spanish Patent ES 2 193 888 infringement, after Bossar's first instance ruling of may 2008.

JUDGEMENT OF THE SUPREME COURT Nº4 OF BARCELONA

• The ruling of the Supreme Court of March 2nd, 2011 condemns Bossar, S.L. to pay the total amount of 291.697,95 € to Mespack, S.L. as compensation for the unjustified damages inputed to the latter concerning the Spanish Patent ES 2 193 888 protecting valve insertion system in duplex on model H 260 FED. Mespack does not produce any more this model for cap application as it has been replaced by newer technology.

• This amount was due to Mespack, S.L. by means of Trustees of Insolvency, as Bossar, S.L. was in that time passing a bankruptcy proceeding.

With this ruling the Supreme Court gives as concluded this long process which in our opinion was from origin completely unjustified as most of the machine manufacturers are using same technology.
